How do I receive help with other types of disability?: Our office handles a variety of employment issues. If you have questions regarding Workers’ Compensation, Social Security Disability or any other employment issue, please contact our office. If it is an issue we cannot handle we will be glad to recommend someone who can assist you.

 

When do I pay for my legal fees?: Our legal fees are paid as a portion of the benefits we are able to obtain for you. Thus, our fee will be paid out of those awards when received. You do not have to pay a retainer. You will be notified if there are any out of pocket expenses or non-compensation issues for which you are responsible.

 

How do I file a workers' compensation claim?: You should file an application with the Bureau of Workers' Compensation (BWC) in order to get a claim number. If your employer is state funded, you should file your application with the BWC. If your employer is self-insured, you may also have a claim application filed directly with your employer.

 

How do my medical expenses get paid?: Your BWC certified doctor must submit his or her bills directly to the MCO for payment.

 

How long will it take for my compensation to begin?: This is often the most difficult question to answer. It may be a matter of days, weeks or sometimes more than a month. Unfortunately, this issue has many variables: How quickly will your doctor send documentation? Will the employer certify your claim? How busy is the Bureau of Workers’ Compensation? The BWC normally makes a decision on your claim within 28 days (if the claim is certified and the medical is readily available, it may be a matter of several days). If the employer objects, you may have to go through at least one hearing before you receive compensation. You should be aware that Workers’ Compensation will NOT pay you for your first week of missed work unless you miss 14 days in a row. Once you are off 14 days they will pay you for the first 7.

 

Can Strauss Law Office recommend a doctor who will take workers' compensation patients?: Strauss Law Office does not recommend any particular doctor. Recommending a particular physician is a bad practice for several reasons: First, we do not want the appearance that we are choosing your doctor. Second, everyone’s needs are different. However if you cannot find a BWC certified physician we certainly will try to assist you. We will be happy to supply you with the BWC list of certified doctors.

 

Can I switch doctors?: Yes you can, however, you will need to fill out a change of physician form, which can be obtained from the Bureau of Workers' Compensation or you can pick up a copy at our office.
